GUARANTEE: Each and every product we manufacture is guaranteed to be free of manufacturing defects. We will replace (at no additional charge to you) any defective product. For purposes of this agreement, the term “defect” or “defective” means a manufacturing error. Since our products are custom made, all sales are final. We require that you review all steps of approval carefully and thoroughly to make sure what you approve is what your order will be. Once an order has been placed, it may not be canceled for any reason. If you have a claim, it must be submitted to us in writing within 10 days of receipt. We do not issue refunds or offer discounts and credits.

PROOF & ARTWORK: An art proof will be emailed to you prior to production for your review and approval. This is the time to make any changes and to double-check the artwork for any spelling errors, color changes and sizing. On products that require dies, molds and set up fees – once this art is approved we go to the mold, die or setup. If we make the die, mold or do the set-up as it relates to the artwork that you approved and you decide to make any changes after this part of the process you will be liable for all charges. Of course if we make a mistake we will correct it. Please check your proof very carefully and thoroughly for spelling errors, as well as layout criteria (size, sewing allowance and/or folds, plating options, levels). Don’t assume anything please let your sales rep know of any concerns or issues you think you might have before submitting your approval.
PRODUCTION TIMES: vary depending on the items ordered. Standard lead times are usually 10 to 15 working days and please let us know if you have a deadline,
PRE-PRODUCTION SAMPLES: Digital or physical samples are a great way to make sure your order is exactly the way you envisioned it. Our products that transition from art proof to finished products will include a digital photo scan for final approval before production can start. On Lapel Pins you need to request a Digital Sample at the time of order. Mailing physical pre-production samples are available on request. Pre-production sample charges vary by product. Please feel free to ask us for different options that may be available and sample turn around times. Most physical preproduction samples will add additional time to the order process, usually up to 7 to 10 days.
PROOF APPROVAL: An art proof is NOT the pre-production sample. These are separate approval stages. The art proof is a graphic layout of your projects design. The preproduction sample is an actual digital replica of your product. If your product requires both an art proof and pre- production sample please make sure you are aware of when to approve them in a timely manner so your production is not delayed. Remember we offer pre-production samples on request. Whether you are approving an art proof or pre-production sample, we will request your approval in writing (via email) to avoid any confusion. Once production has begun, it is impossible to make any changes without incurring costs.
SHIPPING: It is our goal to ship your product and have it delivered to you on or before the date you need it. Please let us know ahead of time of any deadlines or events to better serve you. We are unable guarantee our deliveries nor be held responsible for delays in shipping which are beyond our control, such as weather, inaccurate/ undeliverable address information, U.S./Foreign Customs procedures, the misrouting of your package by UPS, FedEx or any other carrier used, or the unavailability of the addressee. Additional shipping charges will be applicable for all foreign shipments, including Alaska, Hawaii and Puerto Rico.

SHIPPING INFORMATION: We rely on our customers to supply us with accurate shipping addresses and our shipping carriers to deliver your order promptly. We do require a Signature at time of deliver for your protection.
PAYMENT: We accept VISA, MASTERCARD, AMERICAN EXPRESS, DISCOVER and PAY PAL as well as company checks for pre-paid orders. On first orders, 100% down is required when order is placed.
LOGOS AND TRADEMARKS: By submitting your design to The Monterey Company, Inc you warrant that you have the legal right to reproduce the design. We assume no liability in any trademark, service mark or copyright infringement disputes. The purchaser agrees to assume any liability resulting from actions or demands brought against us including PATENT or COPYRIGHT infringements.
DISCLAIMER OF WARRANTY: We do not warrant or guarantee the merchantability or fitness of the products we manufacture for any particular purpose, use or event. In the event that a legal dispute arises, it is agreed that the exclusive jurisdiction and venue for such a dispute is Santa Barbara, CA USA. The prevailing party is entitled to an award of reasonable attorney’s fees. Should The Monterey Company, Inc. be named in a copyright or trademark infringement lawsuit arising out our manufacturing your product for you, you agree to defend us in any disputes over your particular product. By placing your order you are agreeing to our terms and conditions, which include the indemnifying The Monterey Company, Inc. for any damages.
